Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using any application ("App") developed and published by Montane LLC ("Montane," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our applications. We reserve the right to modify these Terms at any time, and your continued use of our applications constitutes acceptance of any modifications.

2. Description of Services

Montane develops and publishes mobile applications for iOS devices, available through the Apple App Store. Our applications may include features such as data tracking, analytics, content management, communication tools, and other functionality as described in each application's App Store listing.

3. User Accounts

Some of our applications may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use our applications to:

  • Violate any applicable laws, regulations, or third-party rights
  • Transmit any harmful, threatening, abusive, or otherwise objectionable content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of our applications
  • Reverse engineer, decompile, or disassemble any part of our applications
  • Use our applications for any unauthorized commercial purpose
  • Collect or harvest any information from other users without their consent

5. Intellectual Property

All content, features, and functionality of our applications — including but not limited to text, graphics, logos, icons, images, audio, video, software, and source code — are the exclusive property of Montane LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

6. User Content

You retain ownership of any content you create or upload through our applications. By submitting content, you grant Montane LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and improving our applications. You represent and warrant that you have all necessary rights to grant this license and that your content does not violate any third-party rights.

7. Privacy

Your use of our applications is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our applications, you consent to the practices described in our Privacy Policy.

8. Third-Party Services

Our applications may contain links to or integrations with third-party services, websites, or content that are not owned or controlled by Montane. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third-party services are governed by their respective terms and policies.

9. Apple Developer Program Compliance

Our applications are developed and distributed in compliance with the Apple Developer Program License Agreement and the App Store Review Guidelines. As a user, you acknowledge that these Terms are between you and Montane LLC, not with Apple Inc. Apple has no obligation to furnish any maintenance or support services for our applications. In the event of any failure of an application to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if applicable); beyond that, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to our applications or your use thereof.

10. Disclaimers

OUR APPLICATIONS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT OUR APPLICATIONS WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MONTANE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE OUR APPLICATIONS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

12. Indemnification

You agree to indemnify, defend, and hold harmless Montane LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of our applications, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of such courts.

14. Termination

We reserve the right to suspend or terminate your access to our applications at any time, with or without cause, and with or without notice. Upon termination, your right to use our applications will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Changes to These Terms

We may revise these Terms from time to time at our sole discretion. When we make material changes, we will notify you through our applications or by other reasonable means. All changes are effective immediately when posted. Your continued use of our applications following the posting of revised Terms constitutes your acceptance of such changes.
